BD2 PROJECT TERMS OF USE (ALL RIGHTS RESERVED)

These terms apply only to the original code, documentation, and configuration of this project that the project rights holder lawfully owns or has the right to license (the “Project Materials”). Obtaining a copy, viewing a public repository, or being able to download or compile the Project Materials does not grant an open-source license or any rights not expressly granted by these terms.
These terms do not retroactively revoke any prior lawful license granted by the actual rights holder that remains in effect.

1. Limited license to use

   Subject to these terms and applicable law, a recipient who has lawfully obtained the Project Materials through a channel designated by the project rights holder may view, compile, run, and modify them for the recipient's own personal learning, research, and local non-commercial testing. This license is non-exclusive, non-transferable, and non-sublicensable; modified materials remain subject to these terms. Use of the Project Materials must not infringe the rights of third parties.

2. Restrictions on distribution and commercial use

   The Project Materials, including all or part of any copy, modified or derivative version, build output, or installation package, may be published or distributed only by the project rights holder through channels it designates. Without the project rights holder's prior express written permission, no other person may:

   - copy for, forward to, upload for, mirror for, host in a public repository for, redistribute to, or otherwise make available to any third party the Project Materials or any modified version or build output;
   - sell, rent, provide for a fee, bundle for sale, monetize through advertising, or otherwise commercialize the Project Materials;
   - use the Project Materials to provide a server, hosting, managed service, or paid access to the public;
   - remove or alter copyright notices, license terms, source attributions, or disclaimers in the Project Materials.

   Permission for any of the above must be expressly given by the project rights holder. Silence, public availability, and receipt of a copy do not constitute permission. Rights expressly granted by law that cannot be excluded by contract remain unaffected.

3. Third-party rights and unofficial status

   Brown Dust II and the associated names, trademarks, game client, images, audio, story, protocols, game data, and other third-party materials belong to their respective rights holders. This is an unofficial local development and research project and is not affiliated with, authorized, sponsored, or endorsed by the game or its rights holders. These terms grant no right to use, copy, modify, or distribute the game client, game data, trademarks, or other third-party materials. Third-party software dependencies, tools, and their respective licenses continue to apply independently; these terms do not alter those licenses.

4. Disclaimer and limitation of liability

   The Project Materials are provided “AS IS” and “AS AVAILABLE,” without any express or implied warranty of correctness, security, fitness for a particular purpose, continued availability, or non-infringement. Users are responsible for determining whether obtaining, running, and using the Project Materials complies with applicable law, relevant agreements, and third-party rights, and assume the risks arising from their use, modification of the game client, handling of game data, or operation of a local server. To the fullest extent permitted by applicable law, the project rights holder is not liable for losses resulting from the use of, or inability to use, the Project Materials. These terms do not exclude liability that cannot lawfully be excluded.

5. Breach of terms

   The limited license granted by these terms terminates automatically upon breach. Termination does not affect the project rights holder's right to seek remedies under applicable law, or the provisions concerning third-party rights, disclaimers, and limitations of liability.

Any authorization beyond these terms requires the project rights holder's prior express written permission.

1. 有限使用许可

   在遵守本条款和适用法律、并且已通过项目权利人指定渠道合法取得项目内容的前提下，接收者可为个人学习、研究及本地非商业测试而查看、编译、运行和为自身使用修改项目内容。此项许可是非独占、不可转让、不可再许可的；修改后的内容仍受本条款限制。使用项目内容不应侵犯第三方的权利。

2. 传播与商业使用限制

   项目内容及其全部或部分副本、修改版、衍生版本、构建产物和安装包，仅可由项目权利人通过其指定渠道发布或传播。未经项目权利人事先明确书面许可，其他人不得：

   - 向第三方复制、转发、上传、镜像、公开仓库托管、再分发或以其他方式提供项目内容及其修改版、构建产物；
   - 销售、出租、收费提供、捆绑销售、用于广告变现或以其他方式将项目内容商业化；
   - 基于项目内容向公众提供服务器、托管服务、代运营服务或付费访问；
   - 去除或篡改项目内容中的版权、许可证、来源和免责声明。

   对上述行为的许可必须由项目权利人明确作出；沉默、可公开访问以及收到本项目副本均不构成许可。法律明确允许且不得以合同排除的权利不受本条款限制。

3. 第三方权利与非官方性质

   Brown Dust II 及相关名称、商标、游戏客户端、图像、音频、剧情、协议、游戏数据与其他第三方素材，归各自权利人所有。本项目是非官方本地开发与研究项目，与游戏及其权利人不存在隶属、授权、赞助或认可关系。本条款不授予任何游戏客户端、游戏数据、商标或其他第三方内容的使用、复制、修改或传播权。项目使用的第三方软件依赖、工具及其许可证仍分别适用；本条款不变更这些独立许可。

4. 免责声明与责任限制

   项目内容按“现状”和“可用状态”提供，不对正确性、安全性、适用性、持续可用性或不侵权作任何明示或默示保证。使用者自行确认其获取、运行和使用行为符合适用法律、相关协议及第三方权利要求，并自行承担使用、修改客户端、处理游戏数据或运行本地服务所产生的风险。于适用法律允许的最大范围内，项目权利人不对使用或无法使用项目内容造成的损失承担责任；本条款不排除依法不得排除的责任。

5. 违反条款

   违反本条款时，本条款授予的有限许可自动终止。终止不影响项目权利人依据法律寻求救济的权利，也不影响本条款中关于第三方权利、免责与责任限制的规定。

任何超出本条款的授权，须事先取得项目权利人的明确书面许可。
